世界农化网中文网报道： 近日，欧洲议会批准通过新的肥料规则草案，该规则涵盖所有类型的肥料（矿物肥、有机肥、土壤改良剂、栽培基质等），将取代现行的旧规则 Regulation(EC) No 2003/2003，并在欧盟理事会批准之后，于2022年正式实施。

本次批准通过的新规则，主要体现在以下三个方面：

一是：提出修改农药管理规则相关条款，明确生物刺激素不属于农药领域

该肥料规则草案的第47章节中指出，修改欧盟农药管理规则Regulation (EC) No 1107/2009中的第2章（article 2）、第3章（article3）和第80章（article 80）。明确植物生物刺激素的界说，而且说明植物生物刺激素不属于农药管理领域。

具体修改内容如下：

原article 2(1) point (b)条款为：

“influencing the life processes of plants, such as substances influencing their growth, other than as a nutrient;”

修改后的条款如下：

"influencing the life processes of plants, such as substances influencing their growth,other than as a nutrient or a plant biostimulant;"

该修改后的条款明确指出，植物生物刺激素不属于农药管辖领域。

在1107 规则的article 3中增加了一段植物生物刺激素的具体界说，如下：

“34"plant biostimulant" means a product stimulating plant nutrition processes independently of the product's nutrient content with the sole aim of improving one or more of the following characteristics of the plant or the plant rhizosphere:

(a)nutrient use efficiency;

(b)tolerance to abiotic stress;

(c)quality traits;

(d)availability of confined nutrients in soil or rhizosphere.”

 植物生物刺激素是独立于植物营养身分的产物，能够促进植物养分的吸收，改善植物或植物根际的营养利用效率、提高植物抗非生物胁迫的能力、革新作物品质、促进土壤或根际的养分有效吸收等。

在过渡条款article 80中增加了一段：

“8. To a product which was granted an authorisation under Article32(1) based on an application submitted before … [date of entry into force of this Regulation ], and which after that date falls under the definition inpoint 34 of Article 3, this Regulation shall continue to apply for the duration provided in the authorisation.".

即在该规则生效之日之前取得PPP产物授权的产物，如果适用于修改后 article 3 中的第34条规定，即属于生物刺激素类产物，应该同时满足本规则关于生物刺激素的相关要求。

二是：统一有机肥料和基于回收废物生产的肥料市场准入，促进该类型肥料的使用

目前欧盟现行的肥料规则主要是对传统肥料(矿物肥、化学肥料)的管理，这一类肥料的生产是高耗能且发生较高的二氧化碳排放量。有机肥料的市场准入主要是由各个成员国单独管理，这样，差异国家的准入规则不统一，使得有机肥料在欧盟单一市场的流通变得困难。

新规则建立了新的欧盟统一的肥料管理规则，降低创新肥料、有机肥料的市场准入尺度，使消费者有更广阔的选择空间；勉励回收质料在肥料生产中的使用，助力生长循环经济。

三是：对部门重金属设置限量，降低健康和环境风险

本次批准通过的新规则引入重金属限量，降低相关肥料产物的使用给人类健康和环境造成的风险。例如，新规则中将磷肥中镉的含量限制为不凌驾60 mg/kg。如果一个肥料产物中镉含量低于20mg/kg,可以在标签上明确标注低镉产物，用于产物市场宣传。据悉，该规则实施四年后，欧盟委员会会进一步评估该项措施的可行性。
